Surrogacy Law in Maryland

no-image State law of Maryland does not define whether surrogacy contracts of any kind may be enforceable in the court of law. The high court of Maryland has allowed gestational surrogates to seek a ruling that she is not the parent based on the lack of genetic connection to the child.

Under Maryland law, it is a crime to receive compensation for gestational surrogacy. See 85 Md Attorney General 348 Opinion, 2000 WL 1922187.
