Many people dream of creating or enlarging their family with a child, but for some people, that dream is harder to achieve than for others. There are many reasons that intended parents may need help to build their families, and many reasons why donors, surrogates, and others may choose to help them. But whatever brings you to the point of considering assisted reproductive technology (ART), you need not navigate the process alone—nor should you.

Building a family through reproductive technology is not just a biological process; it is a legal and emotional process, too. At Brinkley Law Firm, LLC, we are sensitive to the emotional issues involved in the journey to parenthood, and we help you navigate the legal aspects of the process with compassion, care, and clarity. We represent not only intended parents, but egg donors, embryo donors, and surrogates using in vitro fertilization (IVF).

With offices in Charleston and Greenville, our family law firm concentrates its practice exclusively on South Carolina family law. Our experienced attorneys represent clients in a range of family formation matters such as surrogacy, egg/sperm/embryo donation and even adoption. Our dedicated focus has allowed us to develop a depth of experience in this area that we apply to help you move into the next chapter of your family life with confidence.

There may be multiple parties involved in the process of bringing a family’s dream to fruition through ART. All of those parties deserve to be treated with dignity and to have their legal rights protected. Whether you are an intended parent, a donor, or a surrogate, you need to be represented by a knowledgeable attorney whose role is to answer your questions, explain your rights, and protect your interests throughout the process.

Assisted reproductive technology exists at the intersection of medicine and the law, both of which are constantly evolving. The law often struggles to keep pace with medical and technological developments, and there are not always clear legal answers to issues that arise. That’s why it is so critical to work with a law firm for which ART law makes up a substantial portion of its practice. Law firms that do not regularly represent intended parents or other parties to ART may not have the knowledge or experience to adequately advise their clients.

Just as every family is unique, every family law firm is as well. Your choice of firm to represent you in your South Carolina family law matter will deeply impact the outcome of your case, and your experience of the legal process. Here are the reasons clients chose to work with Brinkley Law Firm, LLC.

STEER CLEAR AT ALL COSTS I would happily place this review at ZERO stars if it were possible. I recommend looking elsewhere. Please read the review in its entirety. I was assigned an attorney Christopher Kays for my divorce of 11 months. I was assured by him that this would be a straightforward process where no alimony would be transferred and that due to the short duration of the marriage, there would be little more than 50/50 division of marital assets. That was a complete lie. I understand that attorneys do not have a crystal ball but I was assured that this would be a routine and smooth litigation process due to the short duration of the marriage. Upon realization of the opposition counsel, the attorneys in the office consistently disparaged the opposing counsel and made light of the situation in front of me as if I had nothing to worry about. This law firm was steam rolled in litigating the agreement. I understand that in the state of South Carolina the man in the marriage is likely to lose more than the woman in the marriage. That being said, this law firm decided that it would be fair for me to assume well over 75% of the marital debt, allowed me to lose an entire investment property for which the plaintiff had (as I was told) no right to either the property or the equity in the property since the equity in the property was carried over from a non-marital account. Upon completion of the "agreement" my attorney informed me that I would pay $13,000 in alimony which doesn't include an additional $10,000 in spousal support during the process of the divorce. That I would be required to vacate ownership of an investment property that the plaintiff had no investment or risk or equity in. Upon completion of the agreement that Mr. Christopher Kays assured me was the fairest agreement he'd ever seen, we shook hands and he completely abandoned the case. I was provided some junior attorney that had nothing to do with the case and needed me to pay her very expensive hourly rate to "catch her up" on the case. I sat next to an attorney who allowed completely false "evidence" to be presented at the court hearing, that would be impossible to prove plausible. When asked by the judge about this "evidence" I openly denied it, in front of the judge and the attorney said I wasn't supposed to do that. Due to the "most fair agreement" this attorney's office has abandoned me and I am not legally allowed to speak to the plaintiff in the divorce while selling the property where they handed over the responsibility of selling the property to the plaintiff. She has no claim, title, deed or financial responsibility to the home. Her name is NOWHERE on any paperwork concerning ownership of this property, yet she is in control of the sale of the house. I have called and emailed questions after having been abandoned by this law firm and the litigating attorney of the firm assured me that she would help and not charge me for the questions that I had on the completion of my divorce. I was charged some $375 for a single email and for other questions that wouldn't have had to be asked if I weren't completely abandoned by this firm. If you are going through or about to go through a divorce, for your own good, and at all costs avoid this law firm. Customer service was decent they were really kind and all smiles while they maintained as much time and opportunity to clean you out of money through the difficult process of divorce.
